Viimase aja olukord t\u00f6\u00f6turul on aga toonud kaasa uue, pisut ootamatu mure t\u00f6\u00f6andjatele. Nimelt, mida teha olukorras, kus t\u00f6\u00f6tajaga on t\u00f6\u00f6leping s\u00f5lmitud, kuid t\u00f6\u00f6le asumise aeg ei ole veel saabunud ning \u00fcks osapooltest soovib t\u00f6\u00f6lepingu \u00fcles \u00f6elda? Millised on siis poolte \u00f5igused ja kohustused ning millele peab t\u00e4helepanu p\u00f6\u00f6rama?<\/p>\n<h2>T\u00f6\u00f6lepingust taganemine ei ole v\u00f5imalik<\/h2>\n<p>\u00dcks mis kindel \u2013 t\u00f6\u00f6lepingust lihtsalt taganeda ei ole v\u00f5imalik. S\u00f5lmitud t\u00f6\u00f6lepingu l\u00f5petamiseks tuleb j\u00e4rgida seaduses etten\u00e4htud tingimusi. Oluline on meeles pidada ka seda, et t\u00f6\u00f6andjal ei ole v\u00f5imalik t\u00f6\u00f6lepingut korraliselt \u00fcles \u00f6elda. Temal peavad t\u00f6\u00f6lepingu \u00fcles\u00fctlemiseks olema seaduses etten\u00e4htud m\u00f5juvad p\u00f5hjused, mis annavad aluse erakorraliseks \u00fcles\u00fctlemiseks.<\/p>\n<h2>Korraline t\u00f6\u00f6lepingu \u00fcles\u00fctlemine<\/h2>\n<p>K\u00fcll aga on korralise \u00fcles\u00fctlemise \u00f5igus t\u00f6\u00f6tajal. T\u00f6\u00f6lepingu korralist \u00fcles\u00fctlemist t\u00f6\u00f6taja p\u00f5hjendama ei pea. Sellisel puhul ei ole \u00fcles\u00fctlemise p\u00f5hjustel t\u00e4hendust ning ainuke, mida j\u00e4rgida tuleb, on seaduses toodud <strong>etteteatamist\u00e4htaeg<\/strong>. See aga ongi \u00fcks p\u00f5hiline tingimus, mille vastu paljud t\u00f6\u00f6tajad eksivad. Nimelt ollakse arvamusel, et kui t\u00f6\u00f6le ei ole veel asutud, v\u00f5ib lepingu l\u00f5petada justkui lihtsustatud korras, andes t\u00f6\u00f6andjale teada, et t\u00f6\u00f6le siiski ei tulda. Samuti on esinenud olukordi, kus t\u00f6\u00f6lepingu \u00fcles\u00fctlemine toimub valedel alustel \u2013 n\u00e4iteks katseaja t\u00e4htaegu ja paragrahvi kasutades. Antud juhul ei ole aga katseaeg alanud, seega selline alus ei ole sobilik.<\/p>\n<h2>T\u00f6\u00f6lepingu \u00fcles\u00fctlemise t\u00e4htaeg ning kahju h\u00fcvitamine<\/h2>\n<p>T\u00e4htaeg, mida t\u00f6\u00f6taja j\u00e4rgima peab, tuleneb t\u00f6\u00f6lepingu seaduse (edaspidi TLS) \u00a7 98 l\u00f5ikest 1 ning selleks on v\u00e4hemalt 30 kalendrip\u00e4eva. Kui t\u00f6\u00f6taja etteteatamise t\u00e4htaega ei j\u00e4rgi ning teatab \u00fcles\u00fctlemisest v\u00e4hem, on t\u00f6\u00f6andjal \u00a7 100 lg 5 alusel \u00f5igus saada h\u00fcvitist ulatuses, mida tal oleks olnud \u00f5igus saada etteteatamist\u00e4htaja j\u00e4rgimisel. See t\u00f6\u00f6andja \u00f5igus on midagi, millest paljud ettev\u00f5tjad teadlikud ei ole ning mille rakendamist v\u00e4ga laialdaselt ei kohaldata.<\/p>\n<p>Rohkem on t\u00f6\u00f6andjate teadvusesse j\u00f5udnud TLS \u00a7 74 lg 3, mille kohaselt on t\u00f6\u00f6andjal juhul, kui ta \u00fctleb t\u00f6\u00f6tajaga t\u00f6\u00f6lepingu \u00fcles p\u00f5hjusel, et t\u00f6\u00f6taja ei asu olulise p\u00f5hjuseta t\u00f6\u00f6le v\u00f5i lahkub t\u00f6\u00f6lt ette teatamata, \u00f5igus n\u00f5uda kahju h\u00fcvitamist. Antud s\u00e4te on aga kohaldatav ainult siis, kui t\u00f6\u00f6lepingu s\u00f5lminud t\u00f6\u00f6taja \u00f5igel ajal t\u00f6\u00f6le ei asu ning sellest ega t\u00f6\u00f6lepingu l\u00f5petamise soovist t\u00f6\u00f6andjat ette ei teavita ehk ei j\u00e4rgi \u00fcldse etteteatamist\u00e4htaega. Selline k\u00e4itumine annab aluse t\u00f6\u00f6lepingu erakorraliseks l\u00f5petamiseks t\u00f6\u00f6andja poolt t\u00f6\u00f6tajast tuleneval p\u00f5hjusel. T\u00f6\u00f6andjale sellise k\u00e4itumisega p\u00f5hjustatud kahju suuruse arvutamisel eeldatakse, et kahju suurus vastab t\u00f6\u00f6taja \u00fche kuu keskmisele t\u00f6\u00f6tasule. Juhin t\u00e4helepanu ka sellele, et antud kahju h\u00fcvitamise n\u00f5ude esitamiseks on t\u00f6\u00f6andjale \u00fcsna piiratud aeg ette n\u00e4htud.<\/p>\n<p>Siiski ei ole sellel alusel kahju h\u00fcvitamise n\u00f5ude esitamine t\u00f6\u00f6tajatele meil veel tavap\u00e4rane praktika. Pigem t\u00f5stavad meie t\u00f6\u00f6andjad antud juhtudel k\u00e4ed \u00fcles, v\u00f5tavad seda \u00f5ppetunnina ning p\u00fc\u00fcavad j\u00e4rgmisel korral paremini. On olnud ka juhtumeid, kus t\u00f6\u00f6andjad soovivad t\u00f6\u00f6tajale t\u00f6\u00f6pakkumist tehes rakendada leppetrahvi juhuks, kui siis t\u00f6\u00f6taja mingil p\u00f5hjusel siiski \u00f5igel ajal t\u00f6\u00f6le ei asu, kuid meie t\u00f6\u00f6\u00f5iguses ei ole selliseid s\u00e4tteid ette n\u00e4htud. T\u00f6\u00f6andja saab end kaitsta vaid eespool kirjeldatud alustel ning vahendite abil.<\/p>\n<h2>T\u00f6\u00f6lepingu l\u00f5petamine poolte kokkuleppel<\/h2>\n<p>Mainimata ei saa j\u00e4tta muidugi ka viimast, vast enim kasutust leidvat v\u00f5imalust \u2013 t\u00f6\u00f6lepingu l\u00f5petamine poolte kokkuleppel. Juriidiliselt k\u00f5ige korrektsem oleks sellisel juhul vormistada vastavasisuline kokkulepe, kus pooled kinnitavad oma tahet ning seda, et neil puuduvad teineteise vastu lepingu l\u00f5petamisega seoses v\u00f5imalikud n\u00f5uded. Reaalsus on aga hoopis see, et t\u00f6\u00f6andja v\u00f5tab t\u00f6\u00f6taja \u00fcles\u00fctlemise teatavaks, ei kasuta talle etten\u00e4htud \u00f5iguskaitsevahendeid, ning, nagu varem mainitud, alustab uuesti v\u00e4rbamisprotsessi.<\/p>\n<h2>Oluline on olla teadlik \u00f5igustest ja kohustustest<\/h2>\n<p>Uue praktika tekkimine v\u00f5tab kindlasti aega, kuid ilmselt ei ole enam v\u00e4ga kaugel aeg, kui t\u00f6\u00f6andjad oma \u00f5igusi laialdasemalt kasutama hakkavad, et t\u00e4nases konkurentsis pisutki oma v\u00e4rbamiseks tehtud kulutusi katta. Siit aga meelespea m\u00f5lemale t\u00f6\u00f6suhte poolele \u2013 m\u00f5istlik on olla teadlik k\u00f5ikidest oma \u00f5igustest ja kohustustest.
