Seda seet\u00f5ttu, et <strong>Euroopa Kohtu otsuse kohaselt ei ole igap\u00e4evane puhkeaeg osa igan\u00e4dalasest puhkeajast<\/strong>, vaid igap\u00e4evane puhkeaeg peab eelnema igan\u00e4dalasele puhkeajale. See erineb varasemast arusaamast, kus graafikuga t\u00f6\u00f6tav isik saab seitsme p\u00e4eval jooksul j\u00e4rjestikust puhkeaega v\u00e4hemalt 36 tundi ehk siis igap\u00e4evane puhkeaeg 11 tundi oli varasema t\u00f5lgenduse j\u00e4rgi osa igan\u00e4dalasest puhkeajast.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kuidas puhkeaega uue otsuse j\u00e4rgi arvutatakse?<\/h2>\n\n\n\n<p>Euroopa Kohtu otsuse kohaselt tuleb t\u00f6\u00f6tajale <strong>v\u00e4hemalt kord seitsme p\u00e4eva jooksul tagada j\u00e4rjestikku nii igap\u00e4evane kui ka igan\u00e4dalane puhkeaeg j\u00e4rgnevalt: 11 tundi + 48 tundi = 59 tundi tavat\u00f6\u00f6ajaga t\u00f6\u00f6tajate korral<\/strong> (esmasp\u00e4evast reedeni t\u00f6\u00f6tavad inimesed) ja <strong>11 tundi + 36 tundi = 47 tundi summeeritud t\u00f6\u00f6ajaga t\u00f6\u00f6tajate korral<\/strong> (graafikuga t\u00f6\u00f6tavad inimesed). Antud t\u00f5lgendus ei m\u00f5juta esmasp\u00e4evast reedeni t\u00f6\u00f6tavaid inimesi, k\u00fcll aga summeeritud t\u00f6\u00f6aja ja graafiku alusel t\u00f6\u00f6tavaid inimesi. Seega peab t\u00f6\u00f6andja, kelle t\u00f6\u00f6tajad t\u00f6\u00f6tavad graafiku alusel, koostama graafikuid edaspidi selliselt, et t\u00f6\u00f6tajale j\u00e4\u00e4ks seitsme p\u00e4eva jooksul j\u00e4rjestikust puhkeaega v\u00e4hemalt 47 tundi.\u00a0<\/p>\n\n\n\n<p>Eesti t\u00f6\u00f6andjatel on aega viia muudatused sisse 2023.a. l\u00f5puni, sest j\u00e4relevalvet teostades hakkab T\u00f6\u00f6inspektsioon uuest t\u00f5lgendusest l\u00e4htuma alates 01.01.2024.a.&nbsp;<\/p>\n\n\n\n<p>On ka v\u00f5imalik, et 2024.a. muutub Eesti t\u00f6\u00f6lepingu seadus selliselt, et t\u00f6\u00f6andja saab l\u00e4htuda varasemast kohustusliku puhkeaja m\u00e4\u00e4rast.
