{"id":9494,"date":"2026-02-26T11:25:16","date_gmt":"2026-02-26T11:25:16","guid":{"rendered":"https:\/\/leinonen.eu\/est\/?p=9494"},"modified":"2026-03-13T11:52:23","modified_gmt":"2026-03-13T11:52:23","slug":"uus-voimalus-toosuhtes-paindliku-tooaja-kokkulepe","status":"publish","type":"post","link":"https:\/\/leinonen.eu\/est\/et\/news\/uus-voimalus-toosuhtes-paindliku-tooaja-kokkulepe\/","title":{"rendered":"Paindliku t\u00f6\u00f6aja kokkulepe &#8211; uus v\u00f5imalus t\u00f6\u00f6suhtes"},"content":{"rendered":"\n<p>Riigikogu on p\u00e4rast esialgset eba\u00f5nnestunud menetlust (mis l\u00f5ppes Vabariigi Presidendi vetoga) vastu v\u00f5tnud t\u00f6\u00f6lepingu seaduse muudatused, mille \u00fcheks keskseks osaks on <strong>paindliku t\u00f6\u00f6aja kokkuleppe<\/strong> kasutuselev\u00f5tt.<\/p>\n\n\n\n<p>Varasemalt pidid t\u00f6\u00f6andjad ja t\u00f6\u00f6tajad t\u00f6\u00f6aja ajutiseks muutmiseks sageli s\u00f5lmima t\u00f6\u00f6lepingu lisasid, mis kohandasid t\u00f6\u00f6aega n\u00e4dalate v\u00f5i kuude l\u00f5ikes. Uus seadus annab osapooltele v\u00f5imaluse muuta t\u00f6\u00f6aega paindlikumalt ja oluliselt mugavamalt, ilma et peaks iga muudatuse jaoks eraldi lisakokkulepet s\u00f5lmima.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Milliseid n\u00f5udeid peab t\u00e4itma paindliku t\u00f6\u00f6aja kokkulepe?<\/strong><\/h2>\n\n\n\n<p>Kui pooled soovivad uut t\u00f6\u00f6lepingut s\u00f5lmida v\u00f5i olemasolevat muuta, et kasutusele v\u00f5tta paindliku t\u00f6\u00f6aja kokkulepe, peab kokkulepe kindlasti olema kirjalik ning sisaldama j\u00e4rgmisi elemente:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>kokkulepitud t\u00f6\u00f6tundide arv;<\/li>\n\n\n\n<li>lisatundide arv;<\/li>\n\n\n\n<li>minimaalne etteteatamisaeg lisatundide andmiseks;<\/li>\n\n\n\n<li>teave selle kohta, et t\u00f6\u00f6tajal on \u00f5igus lisatundidest keelduda;<\/li>\n\n\n\n<li>selge m\u00e4rge, et lisatundidega n\u00f5ustumine tuleb t\u00f6\u00f6tajal iga kord eelnevalt kinnitada kirjalikku taasesitamist v\u00f5imaldavas vormis.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Milliste t\u00f6\u00f6tajatega tohib paindliku t\u00f6\u00f6aja kokkulepet s\u00f5lmida?<\/strong><\/h2>\n\n\n\n<p>Paindliku t\u00f6\u00f6aja kokkulepet ei ole lubatud s\u00f5lmida iga t\u00f6\u00f6tajaga. Seadus n\u00e4eb ette kaks kohustuslikku tingimust:<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>t\u00f6\u00f6taja tunnitasu peab olema v\u00e4hemalt 1,2-kordne Vabariigi Valitsuse m\u00e4\u00e4rusega kehtestatud t\u00f6\u00f6tasu alamm\u00e4\u00e4rast;<\/li>\n\n\n\n<li>kokkulepitud t\u00f6\u00f6tundide arv peab olema v\u00e4hemalt 10 tundi seitsmep\u00e4evase perioodi jooksul.<\/li>\n<\/ol>\n\n\n\n<p>NB! Eelnimetatud kokkulepe ei pruugi algselt kokku lepitud tingimuste osas p\u00fcsida t\u00e4htajatuna. Nimelt s\u00e4testab T\u00f6\u00f6lepingu seadus, et kui t\u00f6\u00f6taja on t\u00f6\u00f6tanud viimase kuue kuu jooksul enamuse ajast rohkem kui kokkulepitud t\u00f6\u00f6tunnid, on t\u00f6\u00f6tajal \u00f5igus n\u00f5uda paindliku t\u00f6\u00f6aja kokkuleppe muutmist ja kokkulepitud t\u00f6\u00f6tundide suurendamist. Kui t\u00f6\u00f6andja ja t\u00f6\u00f6taja aga ei j\u00f5ua uues kokkulepitud t\u00f6\u00f6tundide m\u00e4\u00e4ras kokkuleppele, on t\u00f6\u00f6taja kokkulepitud t\u00f6\u00f6ajaks t\u00f6\u00f6andjale taotluse esitamise seisuga t\u00f6\u00f6taja viimase kuue kuu keskmine t\u00f6\u00f6tundide arv seitsmep\u00e4evase ajavahemiku jooksul.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Olulised \u00f5igused ja t\u00f6\u00f6aja arvestus<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>T\u00f6\u00f6tajal on alati \u00f5igus lisatundidest keelduda, n\u00f5ustumist kinnitab t\u00f6\u00f6taja n\u00e4iteks e-kirja teel.<\/li>\n\n\n\n<li>\u00dcletunnit\u00f6\u00f6 arvestatakse juhul, kui t\u00f6\u00f6taja t\u00f6\u00f6tab \u00fcle kokkulepitud t\u00f6\u00f6tundide ja lisatundide.<\/li>\n\n\n\n<li>T\u00f6\u00f6andjal, kellel on kohustus pidada t\u00f6\u00f6aja arvestust (ja summeeritud t\u00f6\u00f6aja korral koostada t\u00f6\u00f6aja kava), tuleb seda teha viisil, mis v\u00f5imaldab selgelt eristada kokkulepitud t\u00f6\u00f6aega, lisatunde ja \u00fcletunde.<\/li>\n<\/ul>\n\n\n\n<p><a href=\"https:\/\/leinonen.eu\/est\/et\/kontakt\/\" target=\"_blank\" rel=\"noreferrer noopener\">Leinonen T&amp;L meeskond<\/a> on valmis t\u00f6\u00f6andjaid selle uue regulatsiooni rakendamisel toetama ja k\u00f5ikidele k\u00fcsimustele vastama.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Riigikogu on p\u00e4rast esialgset eba\u00f5nnestunud menetlust (mis l\u00f5ppes Vabariigi Presidendi vetoga) vastu v\u00f5tnud t\u00f6\u00f6lepingu seaduse muudatused, mille \u00fcheks keskseks osaks on paindliku t\u00f6\u00f6aja kokkuleppe kasutuselev\u00f5tt.
