Visgi, alternatyv\u016bs darbdavio susitarimai su tam tikrais darbuotojais yra galimi.<\/h4>\n<p>DK 33 str. 4 d. numatyta, jog su darbuotojais, kuri\u0173 darbo sutartyje numatytas darbo u\u017emokestis yra ne ma\u017eesnis negu 2 Lietuvos statistikos departamento paskutinio paskelbto \u0161alies \u016bkio vidutinio m\u0117nesinio bruto darbo u\u017emokes\u010dio dyd\u017eiai, galima nukrypti nuo DK ar kitose darbo teis\u0117s normose nustatyt\u0173 imperatyvi\u0173 (privalom\u0173) taisykli\u0173. Statistikos departamento duomenimis, 2022 m. II ketvirt\u012f vidutinis m\u0117nesinis bruto darbo u\u017emokestis (VDU) \u0161alies \u016bkyje (be individuali\u0173j\u0173 \u012fmoni\u0173) siek\u0117 1 780,5 EUR, vadinasi, 2022 m. rugs\u0117jo m\u0117nes\u012f siekiant su darbuotoju sudaryti alternatyv\u0173 susitarim\u0105, darbuotojo m\u0117nesinis darbo u\u017emokestis turi b\u016bti ne ma\u017eesnis nei 3 561 EUR (neatskai\u010dius mokes\u010di\u0173).<\/p>\n<p>Esant poreikiui, su tokiais darbuotojais b\u016bt\u0173 galima susitarti d\u0117l:<\/p>\n<ul>\n<li><span>riboto tam tikr\u0173 papildom\u0173 i\u0161laid\u0173 atlyginimo;<\/span><\/li>\n<li>ilgesni\u0173 atsiskaitymo ar trumpesni\u0173 tam tikros informacijos pateikimo termin\u0173;<\/li>\n<li>darbdaviui naudingesni\u0173 darbuotojo nekonkuravimo susitarimo s\u0105lyg\u0173;<\/li>\n<li>platesnio s\u0105ra\u0161o atvej\u0173, kada darbuotojas privalo atlyginti darbdaviui vis\u0105 padaryt\u0105 \u017eal\u0105;<\/li>\n<li><span>kit\u0173 aspekt\u0173, kurie neprie\u0161taraut\u0173 DK numatytiems reikalavimams.<\/span><\/li>\n<\/ul>\n<p>Atkreiptinas d\u0117mesys, kad DK numato ir s\u0105ra\u0161\u0105 nuostat\u0173, d\u0117l kuri\u0173 susitarti kitaip \u0161alys negali:<\/p>\n<ul>\n<li>maksimalus darbo ir minimalus poilsio laikas;<\/li>\n<li>darbo sutarties sudarymas ir pasibaigimas;<\/li>\n<li>minimalusis darbo u\u017emokestis;<\/li>\n<li>darbuotoj\u0173 sauga ir sveikata;<\/li>\n<li>ly\u010di\u0173 lygyb\u0117 ir nediskriminavimas kitais pagrindais.<\/li>\n<\/ul>\n<p>Bet kuriuo atveju, sudarant susitarim\u0105 su darbuotoju d\u0117l kitoki\u0173 taisykli\u0173 nei yra numatyta DK, privalu, kad b\u016bt\u0173 u\u017etikrinta darbuotojo ir darbdavio interes\u0173 pusiausvyra. Darbuotojas yra laikomas silpnesne darbo santyki\u0173 \u0161alimi, tad piktnaud\u017eiavimas tokiais susitarimais nerekomenduotinas.<\/p>\n<p>Apibendrinant, susid\u016brus su situacija, kai darbo sutarties \u0161alys nor\u0117t\u0173 susitarti d\u0117l kitokios tvarkos, nei yra numatyta DK, rekomenduojame \u012fvertinti:<\/p>\n<ul>\n<li>ar darbuotojo tuometinis darbo u\u017emokestis n\u0117ra ma\u017eesnis nei 2 \u0161alies VDU;<\/li>\n<li>ar klausimas, d\u0117l kurio \u0161alys siekia susitarti, n\u0117ra imperatyvas, d\u0117l kurio susitarti kitaip DK neleid\u017eia;<\/li>\n<li>&nbsp;ar toks susitarimas u\u017etikrins abiej\u0173 darbo sutarties \u0161ali\u0173 interes\u0173 pusiausvyr\u0105.<\/li>\n<\/ul>\n<p>Tik \u012fvertinus min\u0117tus aspektus, \u0161alys tur\u0117t\u0173 sudaryti ra\u0161ytin\u012f susitarim\u0105.
