BDAR reikalavimus pa\u017eeid\u017eiantis asmens duomen\u0173 tvarkymas tokiais atvejais priskiriamas sutartini\u0173 \u012fsipareigojim\u0173 pagal darbo sutart\u012f pa\u017eeidim\u0173 kategorijai.<\/p>\n<p><u>Kyla klausimas, ar auk\u0161\u010diau nurodyti veiksmai yra tinkama priemon\u0117 siekiant valdyti asmens duomen\u0173 saugumo pa\u017eeidim\u0173 rizik\u0105? <\/u><u><\/u><\/p>\n<p>Pa\u017eym\u0117tina, jog nors bendrov\u0117se su duomen\u0173 apsauga susijusius procesus <i>(tokius kaip pa\u017eeidim\u0173 rizik\u0173 valdymas, duomen\u0173 subjekt\u0173 pra\u0161ym\u0173 vykdymas, atsakin\u0117jimas \u012f u\u017eklausas, ir t.t)<\/i> \u012fgyvendina atsakingi darbuotojai, visgi BDAR 82 str. 2 d. numato, kad <u>u\u017e \u017eal\u0105, atsiradusi\u0105 d\u0117l neteis\u0117to asmens duomen\u0173 tvarkymo yra atsakingas duomen\u0173 valdytojas, t.y. bendrov\u0117, darbdavys.<\/u> Remiantis Valstybin\u0117s duomen\u0173 apsaugos inspekcijos rekomendacijomis, bendrov\u0117s darbuotojai n\u0117ra laikomi duomen\u0173 tvarkytojais. Taigi, remiantis auk\u0161\u010diau i\u0161d\u0117stytomis nuostatomis<b> u\u017e \u017eal\u0105, kilusi\u0105 d\u0117l neteis\u0117to duomen\u0173 tvarkymo, tiesiogiai prie\u0161 duomen\u0173 subjekt\u0105 atsakys bendrov\u0117, o ne jos darbuotojai.<\/b><\/p>\n<p><b>\u00a0<\/b><\/p>\n<p><b>Tinkamas darbdavio rizik\u0173 valdymas<\/b><b><\/b><\/p>\n<p>Siekiant u\u017ekirsti keli\u0105 asmens duomen\u0173 tvarkymo pa\u017eeidimams bei u\u017etikrinti skland\u017eius asmens duomen\u0173 valdymo procesus, rekomenduojame imtis \u017eemiau nurodyt\u0173 veiksm\u0173:<\/p>\n<p>\u00b7\u00a0<u>Parengti bendrov\u0117s vidaus politikas<\/u>, nustatan\u010dius asmens duomen\u0173 tvarkymo ir apsaugos standartus bei su jais nustatyta tvarka supa\u017eindinti darbuotojus;<\/p>\n<p>\u00b7\u00a0<u>Informuoti darbuotojus<\/u> apie j\u0173 \u012fsipareigojimus tvarkant asmens duomenis;<\/p>\n<p>\u00b7\u00a0<u>Apmokyti darbuotojus<\/u>, kokiais b\u016bdais ir priemon\u0117mis turi b\u016bti u\u017etikrinama asmens duomen\u0173 apsauga bendrov\u0117je;<\/p>\n<p>\u00b7\u00a0<u>Imtis technini\u0173 apsaugos priemoni\u0173<\/u> (pvz. riboti prieig\u0105 prie asmens duomen\u0173).<\/p>\n<p>Tinkamai \u012fgyvendinus visus auk\u0161\u010diau nurodytus procesus ne tik suma\u017e\u0117ja rizika d\u0117l pa\u017eeidim\u0173 ir \u017ealos atsiradimo, bet ir atsiranda pagrindas reikalauti i\u0161 darbuotojo \u017ealos atlyginimo d\u0117l jo kalt\u0173 veiksm\u0173.<\/p>\n<p><b>Darbuotoj\u0173 atsakomyb\u0117<\/b><b><\/b><\/p>\n<p>&#8211; <u>Materialin\u0117 darbuotoj\u0173 atsakomyb\u0117<\/u><u><\/u><\/p>\n<p>Tais atvejais, kuomet laikantis BDAR numatyt\u0173 reikalavim\u0173, pritaikius organizacines bei technines priemones asmens duomen\u0173 apsaugai, <u>\u017eala kyla d\u0117l darbuotojo kalt\u0117s, bendrov\u0117 \u012fgyja teis\u0119 reikalauti i\u0161 darbuotojo \u017ealos atlyginimo.<\/u> Visgi, darbuotojo atsakomyb\u0117s apimtis riboja Lietuvos Respublikos Darbo kodekso (toliau \u2013 DK) nuostatos:<\/p>\n<p>\u00b7 i\u0161 darbuotojo galima reikalauti ne daugiau kaip 3 jo vidutini\u0173 darbo u\u017emokes\u010di\u0173 (toliau \u2013 VDU) dyd\u017eio \u017ealos atlyginimo;<\/p>\n<p>\u00b7 jeigu \u017eala padaryta d\u0117l didelio darbuotojo neatsargumo \u2013 ne daugiau kaip 6 VDU;<\/p>\n<p>\u00b7 tais atvejais, kai \u017eala padaryta ty\u010dia, auk\u0161\u010diau numatyti apribojimai netaikomi.\u00a0Siekiant \u012frodyti ty\u010dia darbuotojo veiksmuose, bendrov\u0117 prival\u0117t\u0173 \u012frodyti, kad darbuotojas <u>gal\u0117jo imtis veiksm\u0173 \u017ealai i\u0161vengti, ta\u010diau s\u0105moningai to nepadar\u0117. <\/u><\/p>\n<p>&#8211; <u>Darbo sutarties nutraukimas<\/u><u><\/u><\/p>\n<p>DK nuostatos numato galimyb\u0119 nutraukti darbo sutart\u012f su darbuotoju, kuris padaro darbo teis\u0117s normomis arba darbo sutartimi nustatyt\u0173 pareig\u0173 pa\u017eeidim\u0105 (DK 58 str.). Tais atvejais, kai darbuotojo pareigos apima ir asmens duomen\u0173 tvarkym\u0105, \u0161is procesas taip pat turi vykti remiantis teis\u0117s akt\u0173 reikalavimais bei bendrov\u0117je patvirtintomis vidin\u0117mis tvarkos taisykl\u0117mis.
