While VAT in Latvia is paid by the final consumer, it is a company&#8217;s responsibility to apply the right VAT rate to their products or services. Businesses are also responsible for collecting, correctly reporting and paying this tax on behalf of their customers.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">VAT Rates in Latvia \u2013 A Brief Overview<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The standard VAT rate in Latvia is 21%, but reduced VAT rates of 0%, 5% and 12% are applicable to certain products and services:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>0% VAT rate is applied to things like exports, ship and aircraft supplies, and supplies of non-community goods in customs warehouses and free zones. It is important to note that 0% VAT is different from being VAT exempt.<\/li>\n\n\n\n<li>5% VAT rate is applied to printed publications like books and magazines, provided they are published in Latvian, an official EU language, or an OECD language. Since 1 January 2026, publications in other languages no longer qualify for this reduced rate and are taxed at the standard 21%.<\/li>\n\n\n\n<li>12% VAT rate is applied to things like medicines and medical devices, special food for infants, wood and heat supplies for household consumption, and fresh fruits and vegetables.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In addition, from 1 July 2026 to 30 June 2027, a temporary 12% VAT rate applies to a wider basket of essential foods as part of a one-year pilot project introduced in the 2026 state budget. This includes bread, fresh milk (excluding UHT), fresh or chilled poultry (excluding frozen), and fresh eggs. Businesses should check carefully whether a given product qualifies, since only the specific items listed in the amended VAT law benefit from the reduced rate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A comprehensive list of goods and services subject to each VAT rate can be found in <a href=\"https:\/\/likumi.lv\/ta\/en\/en\/id\/253451\" target=\"_blank\" rel=\"noreferrer noopener\">Latvia&#8217;s VAT law<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Common VAT Mistakes in Latvia<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Navigating VAT rules can be daunting, especially for foreign-owned companies with little experience in Latvian VAT regulations.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Here are 7 mistakes we frequently encounter as tax experts:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Incorrect deductions. Businesses or individuals sometimes fully deduct input tax for costs where there are limits imposed on this (e.g., business lunches, event organization and company cars).<\/li>\n\n\n\n<li>Incorrect prorate calculation. This mistake is often made when a company deals with both VAT taxable and VAT non-taxable transactions.<\/li>\n\n\n\n<li>Applying the wrong VAT rate. For example, applying a 0% or 5% VAT rate to a product or service subject to the standard 21% VAT rate, or applying the 5% rate to a foreign-language publication that no longer qualifies under the 2026 rules.<\/li>\n\n\n\n<li>Not reporting VAT promptly. Doing VAT calculations at the wrong time can lead to late reporting that results in penalties.<\/li>\n\n\n\n<li>Incorrectly applying tax to specific VAT regimes. For example, businesses may apply a reverse charge in cases where this is not appropriate.<\/li>\n\n\n\n<li>VAT exemption errors. Understandably, many companies mistake 0% VAT for VAT exemption. However, products and services subject to 0% VAT are reported and taxed differently to those that are VAT exempt. VAT on exempt goods and services should be prorate calculated, as there is no VAT deductible. On the flipside, input tax is deductible on goods and services subject to the 0% VAT rate (e.g. exports). Some financial services are also exempt from VAT in Latvia, but the VAT law does not clearly specify which. This can sometimes lead to incorrect application of VAT exemption.<\/li>\n\n\n\n<li>Documentation errors. These errors are common and often include things like incorrect reporting periods, and not providing the right source documents to justify applying a reduced VAT rate (e.g., 0%). Without adequate supplementary documentation, the tax authorities may challenge a company&#8217;s VAT deduction rights.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">What are the Penalties for VAT Mistakes in Latvia?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>For Incorrect Filing: <\/em><\/strong>Incorrect filing can lead to errors in tax calculations and ultimately non-declared VAT. <a href=\"https:\/\/taxation-customs.ec.europa.eu\/document\/download\/2298c1d9-0704-481a-9616-1082cf6b094e_en\" target=\"_blank\" rel=\"noreferrer noopener\">The interest of 0.05% <\/a>of the unpaid or wrongly calculated tax per day will be applied.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>For Late Filing: <\/em><\/strong>The State Revenue Service (SRS) may impose a penalty of \u20ac 285 up to \u20ac700 for late submission (more than 30 days) of a VAT return.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">VAT Mistakes in Latvia: A Frequently Encountered Case Study Example<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><em>A company was finding it hard to figure out whether their goods were subject to VAT at a standard or reduced rate, and ultimately opted to incorrectly apply the reduced VAT rate. A situation like this could lead to SRS penalties.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>With the support of accountants who have knowledge of VAT rules in Latvia, situations like this can be avoided.<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How do Changes to VAT Regulations Affect Businesses?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Changes to laws surrounding VAT in Latvia can easily lead to mistakes being made by businesses. For example, supplies of fresh fruit, berries and vegetables were subject to the reduced 12% VAT rate as a temporary measure from 1 January 2024, and this rate became permanent from 1 January 2026. As these goods were previously subject to the 5% VAT rate, this could lead to the incorrect rate being applied and reported by businesses, particularly where older reference material still describes the rate as temporary. And as we have already discussed, incorrect reporting can result in late payments and, ultimately, fines and other penalties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A further example is the temporary 12% VAT rate introduced for a wider basket of essential foods from 1 July 2026 to 30 June 2027. Since this rate applies to a specific, defined list of products and only for a limited period, it is a likely source of new rate misclassification errors during 2026 and 2027.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How to Avoid Making VAT Mistakes in Latvia<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When managing VAT in Latvia, seeking training and resources from tax advisors from the outset is highly recommended.
