This was stated by Deputy Head of the National Police of Ukraine Maxim Tsukiridze. Tsukiridze noted that if an employer makes an illegal decision to release an employee during the COVID-19 quarantine, the employee can contact the police. The actions of the employer will be qualified as gross violation of labor law (Article 172 of the Criminal Code) which stipulates a fine of up to UAH 51 thousand.
“The sanction of the article provides for a fine of two thousand to three thousand non-taxable minimum incomes of citizens (34- 51 thousand hryvnias). Or being deprived of the right to occupy certain positions. Managers can also be deprived of the right to engage in certain activities for a term of up to three years, or to be punished by correctional labor for a term of up to two years, ”said Tsukiridze.
The deputy chairman of the NPU also informed that if the employer breached the terms of the contract concluded between him and the employee due to the quarantine, the penalty in the form of a fine (up to 850 hryvnias), deprivation of the right to occupy certain positions or engage in certain activities for a term up to five years or up to six months' arrest / up to two years in prison.
“When a person is hired and a contract is concluded between him and the employer, certain conditions are laid down. Employers cannot exacerbate them under the pretext of quarantine, otherwise they will have to be held accountable for such actions. While I have not heard about such cases, everyone is understanding of the situation, ”Tsukiridze added.
Recall that from March 12 to April 3, quarantine was introduced in the Ukraine. Tough measures including cancelation of public transport services have been in place since March 17.
